Terms of Service
These Terms of Service ("Terms") form a binding agreement between you and Concept 7 Development Group LLC ("we," "us," "our"), the operator of the FieldOps Suite Property Care Edition mobile application and related services (the "Service"). By creating an account or using the Service, you agree to these Terms.
1. Eligibility
You must be at least 18 years old and authorized to enter into contracts on behalf of your business to use the Service.
2. Account
You are responsible for keeping your login credentials secure and for all activity that occurs under your account. Notify us immediately at blufftonsoftwashcompany@gmail.com if you suspect unauthorized access.
3. Acceptable Use
You agree NOT to use the Service to:
Send spam, unsolicited messages, or messages that violate TCPA, CAN-SPAM, or any other applicable law.
Harass, threaten, or harm any person.
Misrepresent your identity or business.
Interfere with the Service, attempt to gain unauthorized access, or scrape data without permission.
Use the Service for any illegal purpose.
You are solely responsible for the content you transmit through the Service, including all messages sent to your customers.
4. Customer Communications & Consent
The Service includes tools for sending SMS and email messages to your customers. You are responsible for:
Obtaining and maintaining valid express written consent from each recipient before sending marketing or recurring messages.
Honoring opt-out requests promptly.
Complying with all applicable telecommunications and email laws in your jurisdiction.
We provide infrastructure, but the legal responsibility for the content and consent state of each message you send rests with you.
5. Subscription & Payment
The Service is offered on a subscription basis. Fees, billing cycles, and any free trial terms are disclosed at sign-up. Subscriptions auto-renew until cancelled. You may cancel at any time from within the app or by emailing us; cancellations take effect at the end of the current billing period and we do not provide partial refunds for unused time unless required by law.
6. Third-Party Services
The Service integrates with third-party providers including Stripe, Twilio, SendGrid, OpenAI, Supabase, Cloudflare, and Apple. Your use of those features is also subject to those providers' terms. We are not responsible for outages, errors, or charges originating from those providers.
7. Intellectual Property
We own all rights in the Service, including the software, design, brand, and content we provide. You own the data you upload (client records, photos, quote text). You grant us a limited license to host, process, and display your data solely as needed to operate the Service for you.
8. Termination
We may suspend or terminate your account if you violate these Terms, fail to pay fees, or engage in conduct that exposes us or other users to legal or operational risk. You may terminate your account at any time. Upon termination, we will retain or delete your data per our Privacy Policy.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CONCEPT 7 DEVELOPMENT GROUP LLC SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY OR (B) $100.
11. Indemnification
You agree to indemnify and hold harmless Concept 7 Development Group LLC, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your content, or your violation of these Terms or any law.
12. Governing Law & Disputes
These Terms are governed by the laws of the State of South Carolina, without regard to its conflict-of-laws principles. Any dispute arising out of or related to the Service shall be brought exclusively in the state or federal courts located in Beaufort County, South Carolina, and you consent to the personal jurisdiction of those courts.
13. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you in-app or by email before they take effect. Continued use of the Service after changes constitutes acceptance.
